LLC.

The Harless Creek Catastrophe

retained by the residents of Harless Creek in Pike County
that has been devastated by recent tidal waves of water
that rushed through the community as a result of mining
activities near these peoples' homes.  Many houses were
destroyed and the community in Harless creek was
ravaged.

down Harless Creek in Pike County, Kentucky,
immediately turning the hollow into a dangerous river.
Notice in the video at 2:18 a car with its headlights on being swept down the
hollow.

Notice also at 3:30 an entire shed being carried away like a boat.

The law offices of Pillersdorf, DeRossett and Lane have
filed a lawsuit on behalf of 126 people in the Harless Creek
area in Pike County against two coal companies and their
unknown agents for their mining activities that lead to tidal
wave flooding in the Harless Creek area.  

Attached to the lawsuit are 6 citations that were issued to
the coal company for violations related to the flooding
including mining without a permit, failure to reclaim, and
failure to maintain a settlement pond.

The Harless Creek Catastrophe
Below is helicopter aerial video footage of the Harless
Creek area.  This video was taken in September of
2010, several weeks after the tidal wave hit the
community.
James Dillon Dawson v. John Dorman, et al
On September 23, 2010, the law offices of Pillersdorf,
DeRossett and Lane filed a lawsuit against a police officer
in Ludlow, KY for falsifying evidence in order to charge
someone who had nothing to do with the crime.
The lawsuit alleges that Officer John Dorman collected evidence from a
shoe box at the crime scene, and then collected different fingerprints from
James Dillon Dawson off of a soda can on a different date and place.  
Dorman then intentionally submitted the soda can fingerprints labeled as the
same ones taken from the crime scene shoe box, resulting in the indictment,
arrest and pre-trial incarceration of Dawson before a judge dismissed the
criminal case.

The lawsuit also names Ludlow Police Chief A. Wayne Turner and
Assistant Police Chief Benny Johnson.  All three defendants are sued in
their official and individual capacities.

into the relationship between surface mining
operations in the Harless Creek watershed in Pike
County, Ky. and the severe flooding and damage to
households in the watershed on July 17, 2010.

a political retaliation case in federal court on behalf of
three Plaintiffs against the Rowan County Property
Valuation Administrator Carmen Black.  The Plaintiffs all
assert that they were fired in violation of their First
Amendment Rights of speech and association.

Circuit Court.  Eight families will be the plaintiffs in this

Banner Coal Contamination Case
The law firm of Pillersdorf, DeRossett & Lane has filed
a lawsuit on behalf of 13 Banner, KY residents
against 10 coal industry defendants.  The lawsuit
alleges that the defendants' coal mining activities have
caused the plaintiff's residences to become
contaminated with coal dust and other pollutants.

Lost Creek watershed case
The law firm of Pillersdorf, DeRossett & Lane has filed
a lawsuit on behalf of nearly 30 Perry County
residents against Frasure Creek Mining LCC, its agents
and other unknown defendants.  The lawsuit seeks
damages and injunctive relief for injuries the plaintiffs
suffered due to landslides and flooding that occurred
on June 20, 2011, which were the direct
consequences of Defendants’ extra-hazardous
activities in the watershed.

Brushy water well Damage case
Pillersdorf, DeRossett & Lane has filed in Pike County
Circuit Court a lawsuit on behalf of a married couple
from the Brushy area whose water wells have been
damaged by the mining activities of the Defendant
Excel Mining LLC and its unknown agents.  

The plaintiffs are also suffering personal injury as well
as extensive property damage.

Middlesboro Flooding
The law firm of Pillersdorf, DeRossett & Lane has filed a
lawsuit in Bell Circuit Court on behalf of residents of the
Yellow Creek, Stony Fork Creek and Stevenson Creek
watersheds in Bell County, KY.  The law firm will be
working alongside and co-counsel this case with the
law firm of Taylor, Keller & Oswald of London, KY.

The lawsuit seeks damages and injunctive relief for
injuries the Plaintiffs suffered due to a catastrophic
flood that occurred on June 20, 2011. The flooding they
experienced on that date was a direct consequence of
Defendants’ ultra-hazardous activities in the watershed.

Samons v. ADT
Piilersdorf, DeRossett & Lane filed a lawsuit on behalf
of Elfriede Samons, a 91-year old Floyd County
resident, against security company ADT when the
company failed to properly notify Samons's family after
she fell and injured herself in her home.  Though police
were called, Samons lay injured for nearly three hours.
