Lost Creek watershed case
|
The law firm of Pillersdorf, DeRossett & Lane has filed
a lawsuit on behalf of nearly 30 Perry County
residents against Frasure Creek Mining LCC, its agents
and other unknown defendants. The lawsuit seeks
damages and injunctive relief for injuries the plaintiffs
suffered due to landslides and flooding that occurred
on June 20, 2011, which were the direct
consequences of Defendants’ extra-hazardous
activities in the watershed.

Brushy water well Damage case

Pillersdorf, DeRossett & Lane has filed in Pike County
Circuit Court a lawsuit on behalf of a married couple
from the Brushy area whose water wells have been
damaged by the mining activities of the Defendant
Excel Mining LLC and its unknown agents.
The plaintiffs are also suffering personal injury as well
as extensive property damage.

Lost Creek watershed case

Pillersdorf, DeRossett & Lane has filed a motion to the
Perry Circuit Court to file an amended Complaint in the
Lost Creek watershed case.

lawsuit in Bell Circuit Court on behalf of residents of the
Yellow Creek, Stony Fork Creek and Stevenson Creek
watersheds in Bell County, KY. The law firm will be
working alongside and co-counsel this case with the
law firm of Taylor, Keller & Oswald of London, KY.
The lawsuit seeks damages and injunctive relief for
injuries the Plaintiffs suffered due to a catastrophic
flood that occurred on June 20, 2011. The flooding they
experienced on that date was a direct consequence of
Defendants’ ultra-hazardous activities in the watershed.

Environment Cabinet and former Mine Inspector
Greg Stapleton in Pike County Circuit Court on behalf
of residents in Harless Creek in Pike County, KY.
The residents of Harless Creek suffered significant
flooding damage in July 2010 after the
Commonwealth failed to enforce state mining
regulations requiring mining companies to operate
with valid permits and to complete contemporaneous
reclamation on surface mines.

|
On Saturday, June 30, 2012, Ned Pillersdorf threw out the first pitch at a
Little League tournament in Prestonsburg, KY. Little League officials
presented Ned a plaque for his 25 years of service.

A federal court judge ruled against Lloyd's of London
by dismissing their lawsuit asking the court to find
that there is no coverage for Abundance Coal.
Pillersdorf, DeRossett & Lane represented Ray
Slone, President of Abundance Coal and
successfully argued that the court not make that
finding.

filed a request in Pike Circuit Court to file a second
amended complaint in order to add additional
defendants.
Also, the Department for Natural Resources have
appealed the Pike Circuit Court's earlier ruling

Citizens want state to make coal firm replace water wells

State first ordered wells replaced in 2007
|
At least seven Letcher County homeowners who had their water wells
destroyed by mining activity have authorized an attorney to file a lawsuit
against the Kentucky Energy and Environment Cabinet charging the
agency with failing to enforce its own orders against the coal company
that ruined the wells.
In a letter to Energy and Environment Cabinet Secretary Leonard K. Peters,
attorney Ned Pillersdorf says the Cabinet has been violating state mining
law by continuing to refuse to enforce it findings, at least one of which
was issued as early as October 2007, that Sapphire Coal Company
damaged the wells and had two years to provide the homeowners with a
permanent water source.

a lawsuit against Sapphire Mining Inc, Sapphire Coal
Company, United Coal Company LLC and all of their
unknown agents in Letcher Circuit Court. The lawsuit
claims that the Defendants conducted mining activities
that negatively impacted the drinking water of all the
40+ Plaintiffs through contamination and pollution.

Sandra Napier, one of over 40 Plaintiffs in the lawsuit, is pictured in

home of her 96-year old father who has a temporary tank too.
Since they share a common well, Sapphire Coal only paid for one
water tank as part of their agreement with the Cabinet to get these
folks temporary water. Napier paid for her own tank. It cost her $800.
